Carillion and TUPE

On the front page it says the Liquidator has guaranteed salaries for January and the Council is seeking an early handover of March. So the question of whether February will be with or without pay is looming.Isn't there a case for TUPE payments being held by an independent body and ONLY drawn down if needed? Now I can see there will be some drawbacks, but really isn't it just criminal that somewhere along the line that a fund to protect workers has (probably) been used to pay Directors' bonuses.Those TUPE negotiations are usually the most protracted part of the contract. I wonder why?

For once I have to say that Hounslow has been ahead of the game and they deserve credit for their prompt action. I would also venture to suggest that Friends of Parks groups played their part with keeping Hounslow posted regarding the failures in the Carillion contract, not replacing crucial staff, not adhering to certain work schedules etc. So let's hope that that lesson at least is taken on board, that working together and listening can pay dividends.

Normally TUPE has a consultation period designed to protect workers in a transition but a liquidation is not normal, so an orderly handover in the normal way cannot happen.My understanding is that the Carillion LBH parks etc employees have been reassured that they can continue working through February and will be paid. My assumption is they will be paid via the liquidator from funds provided by LBH. I guess a formal transfer onto the council/Lampton payroll will happen 1 March as there will be legal niceties to tie up.
