25  Strikes and he's not out...

Don't know whether to laugh or cry on reading 'Local thief gets asbo'on the home page.This is the pest,the 'Where's Wally'lookalike prat, that has been damaging cars and stealing from them for some time now in the Acton and surrounding areas.Reassuring,isn't it, that after causing much agro.to many people and having been convicted 25 times,he has received an asbo?He must be really chastened and repentant at such a stiff sentence,the poor lamb.

'In the case of Mr. Smith,this asbo will be effective over and above any punishment the courts may have chosen to give him in respect of his criminal activities'.Saying this without any qualifying statement makes it just opinion.How would a custodial sentence of say 3 years be less effective?If I had my way it would be at hard labour.Do you suppose this idiot will now live a crime free life for the length of his asbo?Can you see anyone giving him a job?Can't you see him living a life ,on benefits,of criminality and continuing to be a nuisance at best?The thing about asbo's is that they do not help the community that has been affected by criminal behaviour but they provide an easy option for the perp.This is a good result for him.That much is obvious.

This is what Sgt Ben Clark of the Turnham Green SNT said on the Chiswick forum:I thought I should clarify the position regarding Anti Social Behaviour Orders -An ASBO is a civil process (albeit one carried out in a magistrates court) and as such runs parallel to any sanctions imposed for criminal offences.It thus follows that an ASBO is not, in itself, a punishment and can be imposed even though no criminal conduct has taken place - although this is rare - usually criminal conduct is used as evidence to give to the court when deciding whether an ASBO is appropriate or proportionate. In the case of Mr Smith, this ASBO will be effective over and above any punishment the courts may have chosen to give him in respect of his criminal activities.I hope this clarifies the position that the ASBO was not 'all' that has happened as a result of his previous convictions.

Chris,If you are talking about the front piece on the Chiswick home page it says virtually the same as the one on this site,the yes,I ve read it.I can see that he has been prosecuted but I can't see the punishment,beyond not being able to own a bike or wear a bandana etc.This is laughable.

KeithI personally think he should be punished severely but that's nothing to do with the advice I gave you above.  Did you read what the police said?

Yeah Chris.He is laughing his b***ocks of at society.I take it your car was never broken into by this waste of space.It would be more than reasonable to expect him to be taken off the streets after 25 convictions.If you don't think this to be so,how many would it take?Asbos are a substitute for punishment itwould seem.Or don't you think he should be punished?
